Agreement Between Noise Level Zero, Inc. ("NLZ")
and Users of the NLZero
Conferencing Service ("the service").
- You, the user, agree that use of the service constitutes acceptance of
the terms of this agreement as it exists at the time of such use. NLZ
may change this agreement at any time; notice of a revised version will
be given at the time of user login. The current version of this
agreement will be available online at the service at all times. This
agreement may be terminated at will by either party at any time. This
agreement is governed by the laws of the United States of America and by
the State of Nevada. All parties irrevocably submit to the jursidiction
of Nevada courts.
- NLZ provides the service "as-is" without warranty of any kind. NLZ
disclaims ownership and responsibility for any writings or other works
placed on the service. NLZ neither screens, nor edits, nor approves
writings and works posted to the service. You indemnify and hold
harmless NLZ and all other users of the service from liability for any
damages of any kind arising from your use of the service. You agree to
defend NLZ against all claims, actions, and torts arising from your use
of the service, brought in any court in any jurisdiction world-wide.
- You hold all rights to your writings and other works on the service,
except as follows:
- You grant NLZ a non-exclusive right to store, copy, and reproduce
your writings and other works for presentation to other users on the
system.
- You grant all other users a non-exclusive right to store, copy, and
reproduce your writings or other works for presentation through the use
of client software, for their personal use.
- You grant NLZ a non-exclusive right to publish your writings or other
works in any form on any media for the purposes of promoting the NLZero
conferencing service.
- You are granted the right to store, copy, and reproduce the writings of
other users for your own personal use only. Any further reproduction
requires the permission of the author of that writing, subject to the
fair use provisions of copyright law.
- You are responsible and liable for all writings and other works which
you place on the service, and for any claims or torts which may result,
in any court in any jursidiction. You agree not to post any writings or
other works which are not yours without the permission of the copyright
owner. In the event that any party alleges copyright infringement under
the Digital Millenium Copyright Act (DMCA), NLZ will act immediately to
make the allegedly infringing work unavailable through the service and
will notify the user who posted it. Appeals to such action must take
the form specified by law.
- The service is provided for discussions on the subjects indicated by the
conference and topic. Please be aware that users do not all hold the
same religious, moral, or ethical values. Writings and other works
should strive to be polite and tolerant of the beliefs and opinions of
others. Cursing and personal attacks are inappropriate, do not advance
discussions, and tend to reflect poorly on the author. Sexual and
religious discussions are best kept in topics specifically for them so
that participants may be forewarned of the likely content and can avoid
them if they like. Volunteer moderators are appointed by NLZ for every
conference to help keep conversations active and civil. Moderators are
empowered by NLZ to move postings between topics or in extreme cases to
suppress them altogether. Complaints about moderators or other users
may be addressed to the Chief Moderator, but you should make an effort
to resolve differences yourself first.
- You agree to use the service for lawful purposes only. You agree to
make no effort to breach the security or to damage the functioning of
the service, nor to use the service to breach the security of or to
damage any other computer system. You agree that you will not use your
access to the service for advertising either in the conferences nor
using the service's email facility. You agree to carefully guard your
password and to notify NLZ immediately if you discover that your
password has been compromised or believe that system security has been
breached. You agree to provide NLZ with your true legal name and
physical mailing address at the time of registration and to advise NLZ
of changes to either. NLZ agrees to hold address information in
confidence. The service is not anonymous: Other users will be able to
learn your true name from the service.
- You agree to pay all charges that accrue to your account through your use
of the service. Current fee schedules will be provided on the service
at all times, and you will be notified of changes at the time of login.
You may cancel your account at any time. Any refunds will be calculated
pro rata to the end of the current quarter.
